The interest rate is 1% per month, or part of a month, on the unpaid tax.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"3_Prosecution\"><\/span>3. Prosecution:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"padding-left: 40px;\">If you willfully fail to file your ITR, you may be prosecuted by the Income Tax Department. The punishment for willful default is imprisonment for a term of three months to two years, along with a fine.<\/p>\n<p>It is important to note that the penalties for late filing of ITR are in addition to the tax liability that you may have.
